The UK government has announced it will remove the T8 exemption, which currently allows mechanical treatment of end-of-life tyres without a permit, as part of broader reforms to the waste exemption regime under the Environmental Permitting Regulations. The Department for Environment, Food & Rural Affairs (DEFRA) and the Welsh Government say the move is designed to curb illegal waste activity and improve environmental protection.

The decision follows evidence of widespread abuse of the exemption, including excessive stockpiling and illegal processing. Once implemented, operators who previously relied on the T8 exemption will be required to either cease operations or obtain a full environmental permit. The transition period for compliance will be three months from the date the new regulations take effect.

According to Defra, the removal of the T8 exemption is expected to reduce fire risks and prevent criminal misuse, while supporting legitimate businesses that currently face unfair competition from unregulated operators. This change will not affect tyre fitters, garages, or roadside recovery services that only store tyres temporarily before collection, as they remain covered under other exemptions.

The T8 reform is part of a broader package of changes that include stricter recordkeeping requirements, new limits on exemption use near permitted sites, and revisions to several other exemptions including T4, T6, T9, and U1.

Long called for by industry stakeholders, the change is viewed as a step toward a more level playing field and improved environmental oversight. However, tyre retailers and others storing tyres on-site prior to collection will not be affected, as they operate under different exemptions.

Despite the policy shift, concerns remain about enforcement—particularly whether unlicensed operators will continue business as usual. The upcoming introduction of digital waste tracking systems is seen as a potential next step to improve traceability and deter illegal practices.
